Terms of service
KANAWA • Legal Agreement
Welcome to Kanawa! The terms “we”, “us”, and “our” refer to Kanawa. Kanawa operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).
Kanawa is powered by Shopify, which enables us to provide the Services to you. The terms and conditions below, together with any policies referenced herein, describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover matters such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our
Privacy Policy
.
If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state, or province of residence.
To use the Services, you may be asked to provide certain information, including your email address, billing information, payment information, and shipping information.
You represent and warrant that all information you provide is accurate, current, and complete. You are solely responsible for maintaining the security of your account credentials and for all activity carried out through your account.
We make every reasonable effort to provide an accurate representation of our products. However, colours, textures, proportions, and product appearance may vary depending on your device, screen settings, lighting conditions, and photographic representation.
Product descriptions, prices, availability, and specifications may be changed at any time without prior notice. We reserve the right to modify or discontinue any product at any time.
When you place an order, you are making an offer to purchase the selected products. Kanawa reserves the right to accept or decline an order for legitimate reasons, including product availability, payment issues, suspected fraud, pricing errors, or incorrect customer information.
In accordance with applicable European Union consumer protection legislation, eligible customers may have the right to cancel their purchase within 14 days of receiving the order, subject to legal exceptions and the conditions set out in our
Refund Policy
.
You represent and warrant that purchases made through the Site are for personal use and not for unauthorised commercial resale.
Prices, discounts, promotional offers, and product availability may change without prior notice.
Unless explicitly stated otherwise, displayed prices may exclude shipping, handling, customs duties, import taxes, or other local charges applicable outside the European Union.
You represent and warrant that the payment information you provide is accurate and that you are authorised to use the selected payment method.
Shipping
Delivery times are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, customs procedures, strikes, weather conditions, or incorrect delivery information.
Kanawa is not responsible for delays directly caused by carriers, customs authorities, or events beyond our control.
Intellectual Property
All Site content, including trademarks, logos, photographs, images, graphics, designs, product names, text, videos, and other materials, is owned by or licensed to Kanawa and is protected by applicable intellectual property laws.
Copying, reproducing, distributing, modifying, publishing, or commercially exploiting this content without prior written authorisation is prohibited.
Shopify
Kanawa uses Shopify as its e-commerce platform. All sales are made directly between the customer and Kanawa.
Shopify provides the technological infrastructure used to operate the Site but is not the seller of Kanawa products and is not responsible for the contractual relationship between Kanawa and the customer.
Except where expressly stated or required by applicable law, the Services are provided on an “as available” basis.
Nothing in these Terms excludes, restricts, or affects any mandatory consumer rights available under Portuguese or European Union law, including legal rights relating to defective goods or lack of conformity.
In the event of a consumer dispute, the customer may use an authorised Alternative Dispute Resolution entity.
Customers may consult the CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo — or another competent consumer arbitration centre.
